@Kot, with its registered office at Diamantstraat 8, 2200 Herentals, and with company number BE0407.866.588 (hereinafter: COMPANY”) attaches great value and importance to your privacy and the secure processing of your personal data when using the website atkot.be. We wish to protect the data of visitors to our website (hereinafter: “Visitors”) against loss, leaks, errors, unauthorized access, and any other unlawful processing.

We will therefore process your personal data exclusively in accordance with the European Regulation of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) as well as the Act of July 30, 2018, on the protection of natural persons with regard to the processing of personal data.

With this privacy statement, @Kot wishes to inform you, as a data subject within the meaning of the GDPR, about our data processing activities and to provide you with comprehensive information, including the types of personal data we collect about you, where we obtain this data, how we use the data we collect about you, how long we retain your data, to whom we may disclose this information, and your rights regarding the processing of your personal data.

@Kot would like to point out that providing certain required personal data is a necessary condition for us to be able to provide our services. If the aforementioned personal data is not provided, @Kot will be unable to provide the services, or will only be able to provide them in a limited manner.

Where necessary, we will ask you, as the data subject, for your informed, freely given, unambiguous, and specific consent to carry out certain processing activities.

5. FOR WHAT PURPOSES IS YOUR PERSONAL DATA PROCESSED?

@Kot processes your personal data to properly provide the services you have requested or received, as well as to ensure that the website’s features function correctly and intuitively, and to respond appropriately to your requests when necessary. @Kot also processes your personal data to provide you, as a visitor to the website, with a secure, optimal, and personalized user experience.

The processing of personal data belonging to Customers and Visitors is primarily aimed at the following specific purposes:

  • To allow us to contact you in response to your specific request submitted via the contact form or by email;

  • To tailor the website to your specific needs;

  • Improving our services;

  • To answer your questions, whether you submit them by phone, through the contact form on the website, or by email;

8. YOUR RIGHTS AS A DATA SUBJECT

            8.1. Guarantee of compliance with the principles specific to the processing of personal data

@Kot processes your personal data only:

  • In accordance with the purposes set forth herein or in a manner that is not inconsistent with such original purpose;

  • In a fair, lawful, and transparent manner, with the processing based, as appropriate, on the following legal grounds:

    • Consent: Personal data will be processed with your consent.

    • Legitimate interest: Personal data may be processed if it is in the legitimate interest of @Kot as a business, provided that your personal interests do not override those interests.

    • Legal Basis: The processing of personal data is necessary for the performance of the agreement with @Kot.

    • Legal obligation: The processing of personal data is necessary to enable @Kot to comply with its legal obligations.

  • In a manner that is proportionate to the intended purpose;

  • Properly;

  • In principle, for a period equal to five (5) years following the last activity on the website or five (5) years following the performance of the agreement;

  • In cases specified by law, for a period equal to the statutory retention period;

  • In a manner that provides adequate safeguards against unauthorized access, unlawful processing, and/or accidental loss or damage.

            8.2. Right of access

Any Customer or Visitor who provides sufficient proof of identity has the right to obtain confirmation from @Kot as to whether or not personal data concerning them is being processed and, if so, to access that personal data.

You have the right to obtain information about the purposes of processing, the categories of personal data being processed, the recipients of the personal data, the period (or criteria for determining the period) during which your personal data will be stored, and the rights you can exercise under the GDPR.

If you wish to exercise your right to access, correct, or delete your data, @Kot will comply with your request within one (1) month of receiving it, provided that you are entitled to do so. Requests must be submitted by certified mail or via email to: michiel.struijk@atkot.be

Personal data that is incomplete or inaccurate may be corrected or deleted at any time. You may exercise your right to correction by submitting a supplementary statement to @Kot. @Kot will act on this within one (1) month of receiving the supplementary statement.

In addition, you have the right to have @Kot delete your personal data without undue delay. You may exercise this right only in the following cases, which @Kot will assess:

  • When your personal data is no longer needed for the purposes for which it was collected or processed;

  • If you withdraw your consent and there is no other legal basis for the processing;

  • If an objection is raised to the processing and there are no overriding legitimate grounds for the processing;

  • When personal data has been processed unlawfully;

  • When your data must be deleted in accordance with a legal obligation.

            8.3. Right to restriction of processing / Right to object

You have the right to request that @Kot restrict the processing of your personal data if any of the following conditions apply:

  • You dispute the accuracy of the personal data;

  • The processing of @Kot appears to be unlawful, and while you do not wish to have the personal data erased, you do want the processing to be restricted;

  • @Kot no longer needs your personal data for the purposes of processing, but you still need it to establish, exercise, or defend legal claims;

  • @Kot must assess whether the grounds for erasing the personal data exist and continue to do so throughout this period. 

You also have the right at any time to object to the processing of your personal data on grounds relating to your particular situation. @Kot will then cease processing your personal data, unless @Kot can demonstrate compelling legitimate grounds for the processing that override your right to object.

You also have the right not to be subject to individualized and fully automated decision-making if such decisions have legal consequences or could significantly affect you. However, you may always intervene in such decision-making yourself or request human intervention.

Finally, you have the right to object at any time to the processing of your personal data for direct marketing purposes.

            8.4. Right to data portability

You have the right to receive the personal data you have provided to @Kot in a structured, commonly used, and machine-readable format. In addition, you have the right to transmit this personal data to another controller when the processing of your personal data is based solely on your consent.

            8.5. Right to be forgotten

Whenever you have lawfully requested @Kot to correct, delete, or restrict the processing of your personal data, @Kot will notify each recipient of this personal data, unless this proves impossible or would involve a disproportionate effort. You may also request information about these recipients at any time.

            8.6. Right to withdraw your consent / right to file a complaint

You have the right to withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of processing based on consent prior to its withdrawal. In addition, you have the right to file a complaint regarding the processing of your personal data by @Kot with the competent supervisory authorities.

            8.7. Right to information and transparency

When you exercise your rights, @Kot will always act in accordance with the GDPR and will therefore provide all information required by the GDPR in a concise, transparent, understandable, and easily accessible format, which you will receive in plain language.

The deadlines for responding to your requests may be extended under exceptional circumstances, including the complexity or volume of your requests. @Kot will notify you of such an extension and the reason for it within one (1) month of receiving your request.

            8.8. Right to file a complaint

9. SAFE PROCESSING

@Kot acknowledges that the security of personal data is an essential part of data protection.

That is why @Kot takes appropriate technical and organizational measures to protect your personal data against destruction, loss, alteration, unauthorized processing, or unauthorized access in order to prevent misuse.

11. LEADINFO

We use the lead generation service provided by Leadinfo B.V., Rotterdam, Netherlands. The tool identifies business visits to our website based on IP addresses and displays publicly available information to us, such as company names or addresses. In addition, Leadinfo places two first-party cookies to evaluate user behavior on our website, and the tool processes domains from form entries (e.g., “Leadinfo.com”) to correlate IP addresses with companies and improve services.
